These terms are an agreement between you and Elad Hakim, a sole trader in Portugal ("we", "us"). They cover your use of Sixen at sixen.io and in Slack. Our reseller sells the paid plans (section 5).

By creating an account or using Sixen, you agree to these terms. If you don't agree, don't use Sixen.

1. What Sixen is

Sixen helps you understand the people you work with. It reads conversations you choose to bring in, and builds a short read of each person: how they tend to communicate, and how to approach them. Reads are tentative. They're suggestions based on a limited set of conversations, and they can be wrong. You can accept, edit or reject each one.

Sixen isn't a psychological assessment, a diagnosis or a judgment of anyone's ability or worth.

2. Who can use Sixen

  • You must be at least 18 years old, and able to make a binding agreement.
  • You need a Google account with a verified email address to sign in.
  • One person per account. Don't share your account.
  • Sixen is offered to consumers and businesses. Paid plans can be bought wherever our reseller sells them at checkout (section 5). If you're using Sixen for your business, you confirm that you have authority to accept these terms for it.

3. Your account and your data

  • Your content stays yours. That covers the conversations you bring in and your edits. You give us only the permission we need to run Sixen for you: to store, process and show your content to you, as described in the Privacy Policy. We don't sell your content, use it for advertising, or use it to train models.
  • The Privacy Policy explains what Sixen reads, what it keeps, where, for how long, and how you delete it. It's part of these terms.
  • You can delete your data at any time in Settings, including everything at once. Deleting everything also cancels a paid subscription (section 6).
  • Keep your sign-in secure. You're responsible for what happens under your account.

4. Acceptable use

Sixen is for understanding and working better with people. You agree not to use Sixen, or anything it produces:

  1. To make or support decisions about someone's employment. That includes hiring, firing, promotion, pay, performance ratings, discipline or layoffs.
  2. To rank, score or compare people against each other for any such purpose, or to monitor employees.
  3. To bring in conversations you aren't allowed to share. You're responsible for having the right to bring each conversation into Sixen, and for telling the people in it where your workplace rules or local law require it.
  4. To infer or record anyone's health, religion, sexual orientation, political views, ethnic origin or other sensitive characteristics, or to harass, discriminate against or stalk anyone.
  5. To share reads about a person with others as statements of fact, or to publish them.
  6. To break the law, or to interfere with Sixen: reverse engineering, getting around limits or plan restrictions, opening accounts to reuse the free plan, automated access, or overloading the service.

We may suspend or close an account that breaks these rules (section 9).

5. Plans and payment

  • Plans. Sixen has a free plan and paid plans: Plus ($29 a month or $290 a year) and Premium ($99 a month or $990 a year). What each includes is on the pricing page. The free plan includes one upload and reads on up to two people. Paid plans have fair-use limits to keep the service available for everyone.
  • Our reseller. Purchases are processed and sold by our reseller, Sold through Link, LLC (Stripe), under its Sold through Link Terms. These terms govern your use of Sixen. We remain responsible for Sixen itself. We never see or store your card details.
  • Prices and taxes. Prices are in US dollars and don't include tax. At checkout, our reseller adds any sales tax or VAT, shows the total before you pay, and may show the amount in your local currency. Your receipts, invoices and renewal reminders come from Link, and your card statement shows "LINK.COM* SIXEN".
  • Automatic renewal. A paid plan renews automatically at the end of each month or year, at the price then in effect, until you cancel. Our reseller charges your saved payment method on the renewal date.
  • Price changes. We'll tell you at least 30 days before a price change takes effect for your plan. It applies from your next renewal, and you can cancel before then.
  • Failed payments. If a renewal payment fails, it's retried. You keep your plan for up to 7 days after the renewal date while you update your payment details. If payment still fails, your account moves to the free plan (section 6).
  • Changing plans. You can switch plans or billing periods at any time in Settings › Plan › Manage billing. The charge is adjusted for the rest of the period.
  • Founding members. Testers who used Sixen before sign-up opened keep everything in Premium, free, with no end date.

6. Canceling, and what happens to your data

  • Cancel any time in Settings › Plan › Manage billing, or from your order with Link. Your plan stays active until the end of the period you paid for, and then moves to the free plan. You aren't charged again.
  • Moving to the free plan keeps your data. Everything you have stays viewable: people, reads and moments. If you have more people than the free plan allows, the extra people are paused. You can still see and edit them, but Sixen stops adding new reads about them until you upgrade or choose who stays active.
  • Deleting everything (Settings › Delete all data) cancels a paid subscription right away. It doesn't by itself refund the rest of the period; refunds follow section 7. Your customer record at Stripe (your email address and saved payment method) and your invoices stay with Stripe, because invoices must be kept for tax (Privacy Policy, section 6).
  • If you ask Link to delete your data, that cancels your subscription, and your account moves to the free plan. Your Sixen data stays until you delete it in Settings.

7. Refunds and your right to withdraw

  • Refunds are handled by our reseller, under Link's refund policy in the Sold through Link Terms. That includes the 14-day right of withdrawal that EU consumers have, which Link applies.
  • Payment questions, including refunds, charges, receipts and invoices, go to Link support (link.com). For anything about Sixen itself, write to support@sixen.io.
  • Where these terms say we refund something (section 9), we ask Link to issue the refund to your original payment method.

8. Availability and changes to Sixen

  • We work to keep Sixen available and accurate, but we don't guarantee that it will always be available, error-free or right about anyone. Reads are suggestions, not facts (section 1).
  • We may change, add or remove features. If we remove a major feature of your paid plan, we'll tell you in advance, and you can cancel.

9. Suspending or closing an account

  • You can stop using Sixen and delete your account at any time.
  • We may suspend or close your account if you seriously or repeatedly break these terms (especially section 4), if the law requires it, or to protect other people or the service. Where we can, we'll tell you first and explain why. If we close a paid account without a breach on your part, we refund the unused part of the period.

10. Liability

  • Sixen gives suggestions about people. You decide what to do with them, and you're responsible for those decisions and how you treat people.
  • What we don't exclude: liability for death or personal injury caused by our negligence, for fraud, or for anything else that can't be limited by law. Nothing in these terms affects your statutory rights as a consumer.
  • What we do limit: to the extent the law allows, we aren't liable for indirect or consequential losses, or for lost profits, business or data you could have avoided by deleting or exporting data yourself. Our total liability to you is limited to the amount you paid us in the 12 months before the claim, or €100 if you've paid nothing.

11. Changes to these terms

If we change these terms in a way that matters, we'll tell you in the app at least 30 days before the change takes effect. If you don't agree, you can cancel before then. Continuing to use Sixen after that means you accept the new terms.

12. Law and disputes

  • These terms are governed by the law of Portugal.
  • If you're a consumer, you also keep the protection of the mandatory laws of the country where you live, and you can bring a claim in your local courts.
  • Consumer dispute resolution: if you're a consumer, you can bring a dispute to CNIACC, the Portuguese national arbitration center for consumer disputes (www.cniacc.pt). You can also file a complaint in the electronic complaints book (Livro de Reclamações) at www.livroreclamacoes.pt.
  • First, contact us: support@sixen.io. Most problems are solved that way.
